Terms & Conditions

Recharge Escapes LLC d/b/a Solshine Pilates and Sonja Lyth, and The Pilates Krewe Holdings LLC are hereafter referred to as "The Organizers".

To reserve a spot for this retreat, you must provide a non-refundable deposit of $500.

Your balance is due on September 1, 2025. If not paid in full by this date, your spot will not be guaranteed, and you may forfeit your deposit.

Cancellations before September 1, 2025, are fully refundable, less the $500 deposit.

Cancellations before October 1, 2025, are 50% refundable, less the $500 deposit.

Cancelations after October 1, 2025, are not refundable.

Travel insurance is highly recommended to protect you against unforeseen events that could cause you to miss the trip or require emergency services while abroad.

If you would like a roommate, please contact Sonja and Sydney, who will assist you in finding a match. Please note that a match is not guaranteed. If no match is found by September 1, 2025, you will be required to have a single room.

Participation in Pilates-related activities is encouraged but not required. This is a community-building trip, so we expect you to remain with the group for the main activities, although it is not mandatory.

You are responsible for having a valid passport for travel to/from the USA and Mexico that expires no less than six months from the last day of the retreat.

If your actions are deemed inappropriate at any time during the trip, the organizers may request that you forfeit participation in additional group activities. This decision is at the sole discretion of the organizers.

The trip organizers reserve the right to cancel this trip if the required minimum number of participants is not reached by September 1, 2025. In this event, all monies and deposits will be refunded. However, if you have purchased airfare or other trip-related services, the organizers are not liable for these expenses. Therefore, we encourage you to wait until September 1, 2025, before purchasing additional trip-related services.

I, (the “Participant”) hereby agree to the following:

Voluntary Participation. I am participating in pilates mat classes offered by The Organizers and/or its owners, managers, teachers, employees, and independent contractors (collectively, the “trip”). I am aware of the risks of serious injury and/or property damage arising from participation in pilates classes and travel, I, the Participant (or, in the event the Participant is under the age of 18, the undersigned parent or guardian of the Participant, for myself and on behalf of the Participant), agree as follows: I hereby RELEASE and agree to INDEMNIFY, HOLD HARMLESS AND, if requested by The Organizers each and every other person and/or entity that owns, operates or otherwise makes available any of the properties where any of the Activities take place, all of the respective owners, directors, trustees, officers, employees, agents, and affiliates of each of the foregoing persons and/or entities, and any and all coaches, officials, sponsors, organizers, advertisers, volunteers, and equipment suppliers associated with the Activities (collectively, the “Releases”), from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or resulting from, directly or indirectly, my (or in the event the Participant is under the age of 18, the Participant’s) participation in any of the Activities, including, without limitation, those arising out of or resulting from personal injury (including disability or death) and property damage (collectively, “Claims and Liabilities”), regardless of cause, INCLUDING ANY AND ALL CLAIMS AND LIABILITIES WHICH ARISE OUT OF OR RESULT FROM ANY ACTIONS OR OMISSIONS, INCLUDING NEGLIGENCE, on the part of any of the Releases.
Liability Waiver with The Pilates Krewe Holdings LLC. I have signed or will sign and agree to the Liability Waiver with The Pilates Krewe Holdings LLC, provided in a separate document.
I recognize that I must be in acceptable physical and mental health to participate in the Activities. I understand that the Activities may require intense physical exertion, and I represent and warrant that I am physically fit enough to participate and I have no medical condition that would prevent my full participation in the Activities. I recognize that the Activities may cause or aggravate a physical injury or medical condition. I understand that it is my responsibility to consult with a physician before my participation in the Activities. If I have done so, I have taken the physician’s advice. I understand that the trip reserves the right to refuse my participation in an Activity on medical, fitness, or any other grounds. I understand that my participation in this trip may present hazardous conditions and the risk of injury. Despite these risks, I still choose to proceed with such activity. I represent that I know of no physical or mental disorder that should keep me from participating in the Activities, and I agree that I am solely responsible for any and all injuries or harm that I may incur in participating in the Activities. I agree that this agreement shall apply to any incident, injury, accident, or death associated with the Activities, and to any injury, accident, death, or damages occurring as a result of the Activities, any time after the execution of this Agreement.
Media Release. By participating in the Activities I consent to be photographed, filmed, and/or otherwise recorded and agree to releases the right and license to use my likeness and image, taken in connection with the Activities for advertising, publicity, trade, or any other lawful purpose whatsoever, in any medium whatsoever now know or hereafter developed, including without limitation any print media, point-of-sale advertising, video, The Pilates Krewe Holdings LLC and Solshine Pilates LLC websites, and other electronic media without compensation or prior approval.
Release of Claims. In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily, and expressly release, discharge, and covenant not to sue The Organizers, and waive any “Claim” (as defined below) I may have against The Organizers, the studios, its owners, managers, teachers, instructors, workshop presenters, employees, independent contractors and staff (each a “Released Party”) that I may sustain as a result of participating in the Activities at the trip even if the Claim arises from the negligence of any Released Party or anyone else. I agree to indemnify and hold harmless each Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of any Released Party or anyone else. “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering, and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
Force Majeure. The Organizers are not liable for an inability to deliver the Program/Course/content due to a force majeure, whether an act of god or foreseen/unforeseen human-initiated circumstance, health or travel restrictions, quarantines, or precautions imposed by any government entity or agency, local, state or federal law or ordinance, or any other act or circumstance outside of The Organizers control.
Assumption of Risk of Exposure to COVID-19 and other illnesses. By engaging in these Services, I am aware that I agree to fully accept all known and unknown risks, including the potential risk of exposure to respiratory illnesses or other illnesses, diseases, or conditions, including but not limited to the coronavirus known as COVID-19. COVID-19 is primarily transmitted via exhaled respiratory droplets, most often through coughing, sneezing, and breathing in close proximity to another person. These droplets can travel up to six feet or more and are more commonly transmitted between persons rather than from equipment to persons. Although the Service Provider is complying with state laws, executive orders by the governor, federal laws, local laws, and CDC guidelines regarding cleaning, disinfecting, and practices that reduce the potential for exposure to COVID-19, I understand that I may be exposed to COVID-19 or its symptoms through no fault of the Service Provider. Known coronavirus symptoms include fever, coughing, shortness of breath, pneumonia, kidney failure, and may include additional or other symptoms, stroke, or even death (collectively referred to as "Symptoms"). I understand and agree to hold the Service Provider harmless and not liable for any real or perceived Symptoms of COVID-19 or any other disease, illness, or condition, nor for exacerbating any existing Symptoms of any illness, disease, or condition, and I fully agree to accept these and all other known and unknown risks of receiving Services from the Service Provider.
Limitation of Liability. I, my heirs or legal representatives, forever release, waive, discharge, and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of a Released Party. I agree that the substantive law of the state of Maine, exclusive of its conflicts of law rules, shall apply to this agreement. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. I have read this document. I acknowledge that I have carefully read this agreement and fully understand its contents. I understand it is a release and waiver of all claims or rights to file a lawsuit or otherwise recover from releases. I understand I assume all risks inherent in the event and in the Activities I will participate in.
I have been given time to consider whether to sign this release and to review it with my counsel, and have either done so or voluntarily elected not to do so. I have voluntarily signed my name, showing that I accept the above provisions included in this document.
